REFINE BEAUTY – TERMS OF SERVICE

These Terms of Service govern purchases from and use of the REFINE Beauty online store.
By placing an order, you agree to these Terms, subject always to your rights under applicable South African law.

2. ELIGIBILITY
By placing an order, you confirm that you have legal capacity to enter into the transaction or have the necessary consent to do so.
3. PRODUCT INFORMATION
We make reasonable efforts to ensure product descriptions, photographs, colours, specifications and prices are accurate.
Screens, lighting and manufacturing batches may cause minor differences in colour or appearance.
Nothing in this clause permits REFINE Beauty to supply materially different goods contrary to applicable consumer law.
4. PRICING
Prices are displayed in South African Rand (ZAR).
Shipping charges and any other applicable charges will be displayed before checkout where required.
If an obvious pricing or technical error occurs, REFINE Beauty may contact the customer before fulfilment to correct or cancel the affected order where permitted by law.
We will not use this provision to avoid a binding consumer right.
5. ORDERS
Receiving an order confirmation does not necessarily mean an item has already been physically dispatched.
Some items may be sourced after the order is placed.
We reserve the right, subject to applicable law, to decline or cancel orders where:
• stock is unavailable;
• payment has not been authorised;
• fraudulent activity is reasonably suspected;
• an obvious technical or pricing error occurred; or
• fulfilment would be unlawful.
Where payment has already been received and a refund is legally required, the refund will be processed in accordance with applicable law.
6. PAYMENT
Payments are processed through third-party payment providers made available at checkout.
Customers must provide accurate payment and billing information.
REFINE Beauty does not intentionally store complete payment-card details where those details are handled directly by an authorised payment processor.
7. DELIVERY
Delivery is governed by our Shipping Policy, which forms part of these Terms.
Customers must provide accurate delivery information.
8. RETURNS AND REFUNDS
Returns, refunds and warranties are governed by our Return and Refund Policy and applicable South African law.
Nothing in these Terms excludes mandatory rights under the Consumer Protection Act or Electronic Communications and Transactions Act.
9. FREE GIFTS AND PROMOTIONS
Promotions may be subject to qualifying purchase amounts, dates and stock availability.
The current free-gift promotion, where displayed, requires the qualifying order value shown on the website or checkout.
Unless expressly stated otherwise:
• one qualifying gift is available per qualifying order;
• gifts are available while stocks last;
• free gifts are not redeemable for cash; and
• promotional conditions may be amended or withdrawn for future orders.
No change will unlawfully remove rights already acquired on an accepted order.
10. INTELLECTUAL PROPERTY
The REFINE Beauty name, branding, website design, original graphics, written content and other original store materials may not be reproduced, copied, sold or commercially exploited without permission, except where permitted by law.
Third-party trademarks remain the property of their respective owners.
11. PROHIBITED USE
You may not use the website:
• fraudulently;
• to attempt unauthorised access to systems;
• to distribute malicious software;
• to interfere with checkout or payment systems;
• to scrape or reproduce content unlawfully; or
• for any unlawful purpose.
12. THIRD-PARTY SERVICES
Our store may depend on third-party providers such as Shopify, payment processors, couriers and technology providers.
We are not responsible for third-party systems to the extent that responsibility may lawfully be excluded.
However, nothing in this clause removes REFINE Beauty's own obligations to customers under applicable consumer law.
13. IMPORTANT LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, REFINE BEAUTY WILL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL LOSS THAT WAS NOT REASONABLY FORESEEABLE OR WAS CAUSED BY EVENTS OUTSIDE OUR REASONABLE CONTROL.
THIS CLAUSE DOES NOT EXCLUDE OR LIMIT LIABILITY WHERE SOUTH AFRICAN LAW DOES NOT ALLOW THAT LIABILITY TO BE EXCLUDED OR LIMITED.
IN PARTICULAR, NOTHING IN THESE TERMS EXCLUDES RIGHTS OR REMEDIES THAT A CONSUMER HAS UNDER THE CONSUMER PROTECTION ACT OR OTHER APPLICABLE LAW.
14. INDEMNITY
To the extent permitted by law, a user agrees to be responsible for loss or damage caused to REFINE Beauty by that user's unlawful, fraudulent or intentionally harmful conduct.
This clause does not require a consumer to indemnify REFINE Beauty for REFINE Beauty's own unlawful conduct, negligence where liability cannot lawfully be excluded, or breach of statutory obligations.
15. CHANGES TO THESE TERMS
We may update these Terms from time to time.
Changes will apply prospectively from the effective date shown, except where the law permits otherwise.
16. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa.
17. DISPUTES
Customers are encouraged to contact REFINE Beauty first so that we can attempt to resolve any issue promptly.

Nothing in this clause prevents a customer from approaching any consumer-protection body, regulator, ombud, tribunal or court that has jurisdiction.
18. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
